The City Living Apartment is the third Charity Property Foodland have given away. Past promotions have been very successful and raised much needed funds for various charities. This year all the proceeds will go to benefiting the Little Heroes Foundation.   • Terms & Conditions for Foodland Charity Apartment

    1.    The promoter of this promotion is Foodland Supermarkets ABN85 528 062 001of 292 Grange Rd, FLINDERS PARK SA 5025 (" Promoter ").

    2.    Information on how to enter the promotion and prize forms part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry.

    3.    Entry is open to all residents South Australia aged 18 years and over who satisfy the entry requirements as stated in terms 4 and 5. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, and their related bodies corporate are not eligible to enter.

    4.    To enter, participants must spend $30 or more in one transaction, including purchasing any two specifically marked products from their local Foodland store during the promotional period.  Products are specially marked via small "Buy Me To Win" graphic in Foodland advertising including catalogues, television, website and press and are specially marked in Foodland Stores with "Shelf Talkers".

    5.    Participants can enter either by:

    a.     Mail: complete an entry form from a Foodland Catalogue and post along with your original receipt to
    “WIN Foodland City Living Apartment”, Adelaide Mail Centre SA 5880.

    b.     Web: or visit www.foodlandsa.com.au and follow the links to enter your details as prompted.
    Entrants must keep an original copy of their receipt as proof of purchase.

    The first correct entry drawn from each of the monthly draws will receive a $2,000 Foodland Shopping Voucher and a chance to win the Foodland City Living Apartment in the final draw.

    On completion of all monthly draws each of the 5 monthly winners will meet at the Foodland City Living Apartment on the 13th November at 2.00pm for the final draw.

    In their winning order, the 5 draw winners will be asked to draw out a key each.  The contestants will then be asked to try their key into the lock of the Foodland City Living Apartment.  The contestants who’s key opens the lock becomes the winner of the Foodland City Living Apartment. 

    Once the winner of the Foodland City Living Apartment has been determined the remaining 4 draw winners will take part in a second draw which allocates the four minor prizes. Once again in winning order, the 4 remaining draw winners will be asked to draw out a sealed envelope. The envelope will contain a card which will display one of the four minor prizes.


    Should a winner not be able to attend the event, then a representative nominated by the winner may attend the event in their place.  The representative must be registered with Foodland and will need proof that they have been nominated.

    The winner’s prizes drawn will be final and no correspondence will be entered into.

    6.    The Promotion starts at 12:01 AM AEST 4 th June 2012 and closes at 6:00 PM AEST on 28th October 2012 If entering by mail, your entry must be received by the last mail delivery November 2012. ("Promotional Period").

    All monthly winners (5) and consolation prize winners (250 – 50 per draw) will be drawn at PMP Distribution, 168 Cross Keys Road, Salisbury South, SA 5106 at 10am.

    If your entry does not make it in time for the draw it will go automatically into the next draw.  For the final draw, Draw 5, entries must be posted by 2 nd November 2012.

    All entries are cleared out after each draw is completed. Entries are not accumulative.

    The Major Prize Draw will be conducted at Apartment 105, Altitude, Balfours Way, Adelaide, SA, 5000, Tuesday 13 th November at 2pm and the winner will appear in The Advertiser on Wednesday 21st November 2012.

    Draw winners will be notified by phone, consolation winners by letter and all winners will appear in The Advertisers “Public Notices” on Wednesday following the date of drawing.

    7.    There is 1 major prize, 4 minor prizes, 5 monthly prizes and 250 consolation prizes to be won.

    a.    The major prize is an apartment located at Apartment 105, Altitude, Balfours Way, Adelaide, SA.

    i.     The apartment prize comprises of an apartment provided by Little Heroes Foundation and includes the right to become the registered proprietor of the property Apartment 105, Altitude, Balfours Way, Adelaide, SA.  The apartment prize winner takes the property subject to all reservations, easements and restrictions recorded on the Title or otherwise affecting the land including any of the estate guidelines or other planning laws applicable to the land. 

    ii.    The apartment valuation is at $334,000 as at March 2012.  All fees payable in order to transfer the property into the Apartment Prize winner’s name will be paid by Little Heroes Foundation including Stamp Duty, Titles Office Registration Fees and any adjustment required for municipal, water rates and land tax (if applicable).  Neither Little Heroes Foundation nor the Promoter make any warranties as to the liability for rates and other statutory outgoings on and from the date the property is transferred to the Apartment Prize winner which remain the responsibility of the Apartment Prize winner. The value of the prize is inclusive of GST and the Apartment Prize winner acknowledges that it will not be entitled to any Tax Invoice for any supply made in respect of the Apartment Prize.  The total Apartment Prize with furniture is valued at $345,000, as at March 2012.

    iii.  The property will be transferred to the Apartment Prize winner by 30 th January 2013.

    iv.   Subject to the statutory rights and warranties reserved to the Apartment Prize winner in respect of all applicable building laws, Little Heroes Foundation and the Promoter make no representations or warranties and will have no further liability in relation to the property or the house constructed on the property as from the date the property is transferred to the Apartment Prize winner.  The property is transferred as at the date of transfer to the Apartment Prize winner as is where is, except for any liability which cannot be excluded by law. The Apartment Prize winner will be required to sign all documentation submitted by Little Heroes Foundation and or the Promoter in order to become the registered proprietor of the property within a reasonable time of being requested to do so. The Apartment Prize winner acknowledges that by failing to sign the necessary documentation by 29 th November 2011 they will forfeit the Apartment Prize. If the Apartment Prize is forfeited the original winner will be notified and the apartment prize will be awarded via an unclaimed prize draw.

    v.    All legal costs and disbursements of conveyancing relating to the Apartment Prize will be paid by Little Heroes Foundation.  Legal work required to transfer the Apartment Prize to the Apartment Prize winner will be undertaken by the Promoter’s Solicitors, Little Heroes Foundation or such other Solicitors appointed by the Promoter or Little Heroes Foundation at their absolute discretion.  The entrant acknowledges that the Solicitors act generally on behalf of the Promoter and the Apartment Prize winner will sign such acknowledgement or other document required under the Legal Profession Act 2004 required to enable Little Heroes Foundation or other Solicitors to comply with their obligations of disclosure of any potential conflict of interest.  The Apartment Prize winner acknowledges that if he or she elects to obtain independent legal advice the same shall be obtained at his or her own expense.

    b.    There are 5 monthly prizes to be won of a $2,000 Foodland voucher (Draws 1-5).

    c.    There are 250 minor prizes to be won of a $100 Foodland voucher (50 per draw).

    d.    The remaining 4 monthly winners will each win a prize from below selection

    $12,000 Travel Voucher (
    must be redeemed by November 2013)

    $10,000 worth of Foodland Shopping Vouchers (must be redeemed by November 2013)

    $10,000 Good Guys Voucher (must be redeemed by November 2013)

    $8,000 Cash

    e.    Total Prize pool valued at $420,000 including GST.

    8.    Any prizes unclaimed will be entered into an unclaimed prize draw conducted on 12 th December 2012 at PMP Distribution, 168 Cross Keys Road, Salisbury South, SA 5106 at 10am

    9.    Winners must also make themselves available for marketing purposes for example, photography, TV and radio interviews.

    10. No responsibility will be accepted for late, lost or misdirected entries and entry is deemed to be received at the time it is received in the Promoter's database and not the time of transmission by the entrant.

    11. As a condition of entry, mail entries must be a small letter (no larger than 130mm x 240mm, no thicker than 5mm) eligible for the standard local postage rate.  Entries that exceed these dimensions will not be eligible for entry.

    12. Any form of automated electronic entry that does not meet the entry requirements as per clause 4 will be deemed invalid and not counted as a valid entry.

    13. One entry per eligible purchase (see term 4). Multiple entries are accepted however each entry must be made in relation to a separate purchase as per term 4.

    14. All Web participants must retain the purchase receipt for the participating products as proof of purchase for all entries. Failure to produce any purchase receipt when requested may in the absolute discretion of the Promoter, result in invalidation of ALL of a participant’s entries and forfeits any right to a prize.  The Promoter reserves the right to verify the validity of entries.

    15. This is a manual draw. Online entries will be printed out on DL size paper and added to the Mail Entries. Drawn entries will be checked for validity against competition rules of entry as they are drawn. Any entries deemed not valid (as per term 4) will be discarded and the draw will continue until all prizes are allocated.

    16. The Promoter's decision as to the winner is final and no correspondence will be entered into.

    17. The winner may be required to sign an indemnity in a form approved by the Promoter in favour of the Promoter and all involved parties prior to participating. If they do not sign that indemnity form, they will not be able to participate in the Prize.

    18. Foodland vouchers are subject to terms and conditions of use which can be found on each voucher.

    19. Prizes are not transferable or redeemable for cash.

    20. All entries remain the property of the Promoter. The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information to contact you for future promotional, marketing and publicity purposes. Entrants' personal information may be disclosed to State and Territory lottery departments and the winner's name published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out above.

    21. The Promoter and its officers, employees and agents will not be liable for any damage or loss (including but not limited to, indirect or consequential loss) arising from personal injury or death or loss of, or damage to property which is suffered or sustained in connection with the promotion or any prize, except to the extent that liability cannot be excluded by law.

    22. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter, including without limitation technical malfunctions or failures.

    23. The Promoter is not responsible for any technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, or any other technical failures, including any injury or damage to participants' or any other person's computer related to or resulting from participation in or down-loading any materials in this promotion.

    24. If for any reason this promotion is not capable of running as planned in any respect due to any cause beyond the reasonable control of the Promoter, the Promoter reserves the right in its sole discretion to cancel, postpone or amend the promotion subject to the written directions of any competent authority.

    25. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
